| Court acquits AEE from disproportionate assets case | | | JAMMU, AUGUST-21, 2007 (JNF):- Special Judge Anticorruption Jammu Kartar Singh acquitted Tirath Singh Jamwal r/o Janipur Jammu, AEE, PDD from the charges disproportionate assets to his known source of income. In the 28-pages acquittal judgment Special Judge Anticorruption Jammu Kartar Singh after hearing CPO appearing for the Vigilance Organization and Advocate Suresh Sharma appearing for the accused observed that his income from other sources has not be considered by the investigation officer while working out the disproportionate assets. The Special Judge Anticorruption Jammu while acquitting the accused from the charges took serious note of the Investigating officer who conducted the investigation in the case and observed that Investigating officer did not bother to get the income of the accused from the his land assessed but opted a short cut method by making calculations from his salary statements and salary statements of his wife and by getting the house assessed by the engineers of Vigilance organization, came to the conclusion that the accused has disproportionate assets to the tune of Rs 4, 53, 375/-. This evidence is not sufficient to prove the disproportionate assets, which are situated to have been acquired by the accused. The prosecution has not been able to substantiate that the accused committed offence with which he has been charged with. There is no material on record to prove that he is in possession of the said disproportionate assets to his known source of income. He is acquitted of the charges framed against him.
