| HC directs police not to arrest petitioners | | >>Inter-caste marriage case registered | | JAMMU, AUGUST-21, 2007 (JNF):- Justice Hakim Imtiyaz Hussain of Jammu & Kashmir High Court Jammu wing in a writ petition filed by a couple who have solemnized an inter-caste marriage with each other out of love and affection and on their own accord, a case was registered with the Police Station Gandoh u/s 366, 343 and 109 at instance of father and other relatives of the petitioner Neena Devi, has issued notice to the respondents, after hearing Sr. Adv UK Jalali appearing for the petitioners ordered that in the meanwhile, till the objections are filed, petitioner and proforma respondents shall not be arrested in FIR 94/2007 of P/S Gandoh. Sr. Adv UK Jalali seeking police protection in view of threat they are allegedly facing, upon this Court said that these submissions will be considered after filling of the objections. In view of the submissions of Sr. Adv, the petitioners, however, shall be at liberty to approach Court for any further relief when ever need arises. In the petition it has been submitted that petitioner Neena Devi d/o Naib Chand r/o Tehsil Gandoh District Doda, Ashok Kumar s/o Maan Singh of the same village conducted inter-caste marriage on July 15, 2006, the police station gandoh on the complaint father and brother of the girl has registered a case against the couple and brother of the Ashok Kumar. The petitioners filed this petition seeking quashment of the FIR No 94/2007 registered by the P/S Gandoh by virtue of which the petitioners and porforma respondents have been alleged to have committed offence u/s 366, 343 and 109 RPC and also seeking direction to the SSP Gandoh and SHO P/S Gandoh to provide protection to petitioners and proforma respondents from any act of commission or omission at the hands of father and brothers of the Neena Devi.
