Court awards life-imprisonment to accused for murdering his niece

JAMMU, AUGUST-24- Principal Sessions Judge Budgam Mr. Hasnain Masoodi today awarded life imprisonment to Abdullah Sofi s/o Ghulam Ahmad Sofi r/o Pethshahran for committing the murder of his niece Saleema daughter of Ali Sofi besides a fine of Rs 10,000.
The allegation against the accused was that the accused after his release from the jail on the charge of his having killed his wife, started making advances to his niece Saleema , grown up daughter of his brother Ali Sofi. It was alleged that accused constantly and persistently harassed the deceased and tried to coerce her to enter into sexual relation with him. The sexual harassment was resented by the deceased who protested against the behaviour of the accused and reported the matter to her parents. The accused was also alleged to have attempted to commit rape on deceased on the day of occurrence. The father of the deceased in the morning of the day the deceased was murdered by the accused declared his resolve to place the matter before the local elders. According to the prosecution the accused not happy with the protest of the deceased and the decision of her father to present the matter before the elders made up his mind to murder the deceased and even warned mother of the deceased of his intention to liquidate the deceased Saleema. On April 25, 2000, the accused armed with an axe and carrying a small piece of rope followed the deceased to the nearby field where she was carrying cow dung. The accused attacked Saleema and strangulated her and gave an axe blow on her head resulting in her death on spot. The accused committing the murder ran away from the place of occurrence and was after three days arrested by the Tangmarg Police. The accused after his arrest disclosed the place where he had concealed the weapons of offence and it was at the instance of the accused that the weapon was recovered. The police got the post-mortem of the body and after completion of the investigation presented the challan in Court of law. Court on August 20, 2007 declared the accused guilty and convicted him for the offence punishable u/s 302 RPC.
On the quantum of sentence today Principal Sessions Judge Budgam Mr. Hasnain Masoodi after hearing both the sides and perusing the record of the case and also the evidence of the witnesses in his 94 page judgment observed that the eye-witnesses to the occurrence was sufficiently and convincingly reinforced, supported by the corroborative evidence and that the prosecution has proved beyond reasonable doubt that the accused on April 25, 2000 with the intention of causing the death of the deceased attacked her and intentionally killed the deceased. The charge of attempt to commit the rape on the deceased was not to have been proved against the accused. The case was not of the category of rarest of rare case so as too warrant award of death sentence as such the accused sentenced life-imprisonment and fine Rs 10,000 JNF
