| Death due to negligence: Court directs police to register case against ASCOMS | | | Jammu, Aug 27: A local court has directed the police to register a case of alleged death due to medical negligence against Managing Director of Acharya Shri Chander College of Medical Sciences and Hospital, Sidhra, Jammu. The court issued direction under Section 156 (3) CRPC on an application filed by one Muhammad Hanif son of Umar Din of Pampoosh Colony, Janipur Jammu. "SHO Nagrota is directed to register an FIR to investigate the matter under law", the order issued by Forest Magistrate Jammu Muhammad Rafeeq Chak, reads. The applicant alleged that his only son Asif Iqbal was admitted in ASCOMS and was suffering from mild fever at the time of his admission. Asif was given some wrong medicines by the doctors in the hospital, due to which he went in coma and finally breathed his last. Father of a 2 year old boy, Asif was said to be the sole bread earner of the family. His father, a retired cop, alleged that he approached concerned police station and even crime branch of Jammu and Kashmir police for registration of case against the hospital management but all in vain. Disheartened from the department, where he served for more than 35 years, Hanif filed an application before the court through his counsel Advocate Firdous. A. Tak, seeking direction to the police for registration of the case. The court after hearing the counsel for the applicant directed SP Rural to investigate the matter and report. The SP Rural filed his report, wherein inability was expressed to have access to the medical record pertaining to the admission, diagnosis and medicines provided to the deceased. Following the report, the court issued directions to the MD ASCOMS to furnish the medical record of the deceased Asif Iqbal. After going through the medical record, the counsel for the applicant submitted in the court that the same has been tempered with and new pages have been inserted to make the things look different. The counsel also draws the attention of the court towards the writing of the alleged inserted pages with that of other record. The court after going through the record and hearing the arguments of the counsel observed that it would be in the interests of justice and fair play to get the matter investigated by the police in terms of section 156 (3) CRPC and "therefore the original record along with application is forwarded to SHO Nagrota to register an FIR And investigate the matter under law".
