| HC directs appointments of 27 JEs subject to the objections | | | JAMMU, AUGUST-29- Justice Hakim Imtiyaz Hussain of J&K High Court Jammu Wing in a petition seeking quashment selection/appointment of 27 JEs Electrical issued notice to State of J&K through Commissioner/Secretary to PDD, Secretary J&K Service Selection Recruitment Board and 27 private respondents returnable within two weeks and further ordered that in the meanwhile the appointment of private respondents to the post of Junior Engineer Electrical shall remain subject to the objections in the CMP. This direction has been issued in a petition filed by Sahdev Singh challenging the appointment of 27 JEs Electrical who were lesser in merit than the petitioner and have been selected and appointed vide order dated July 18, 2007. In the petition Sr. Adv UK Jalali with Adv Anil Khajuria appeared for the petitioner and submitted that the petitioner being resident of backward area and engineering graduate has done degree in engineering from Government College of Engineering and Technology had applied in pursuance to the advertisement notice issued on September 23, 2004 by virtue of which 315 vacancies of Junior JE (Electrical Grade II) were advertised in PDD of state and in response to advertisement more than 3000 applications forms received and respondent board after considering the number of applications forms had issued notification by virtue of which the board proposed to conduct a screening test and syllabi for the said screening test. It has been alleged that the board had neither conducted any screening test nor any shot listing was done and all the candidates who have applied for the post of JE Electrical had been called for interview. The interviews were conducted from March 24, 2007 to May 4, 2007 in Jammu province and from May 14, 2007 to June 12, 2007 in Kashmir Province. It has been further alleged that time devoted on each candidate has shrunk to 3 to 4 minutes and it is settled law that the interview should last for a minimum period of 15 minutes because it is too short time for judging the merit and over all personality of the person interviewed and referred various judgments of the Apex Court in which the Apex Court has categorically held that the interview should last of a minimum period of 15 minutes. The petitioner prayed before the court for quashing the selection/ appointments of 27 private respondents and also quashment of Rule 6 of J&K Engineering (subordinate) Service Recruitment Rules 1997 and also seeking direction to the SSB to produce the entire of selection process.
