| Democracy, rule of law casualty in J&K: alleges Bhim | | Demands election after fresh delimitation’ | | Jammu September 3- Regretting that that democracy and the rule of law in Jammu and Kashmir has been very sad and disappointing in the past, the Panther Party MLA Harshdev Singh has said that first causality of democracy was the Maharaja who acceded to India followed by dismissal of elected government in 1953 by the intervention of Congress rule in Delhi. Participating in the 2-day meeting of the Working Group headed by Justice Saghir Ahmad to discuss the regional imbalances in development, democracy, secularism and rule of law in Jammu and Kashmir, Harshdev said that secular role of the state was highly impressive for which credit goes to the secular character of the people of Kashmir who demonstrated their oneness in 1947 at the time of India’s partition. Not a single soul was disturbed in 1947 when the entire subcontinent was bleeding with human blood, he added. ‘What happened in 1989-90 when nearly two lakh Kashmiri Pandits were thrown out of their homes’ is known to every body, he remarked. Saying that it was not because of the constitutional mandate and the law but because of the old spirit of tolerance and brotherhood that the people of the state have plasticized and preached secularism as a part of their faith or philosophy, the NPP leader added that it is that spirit which has brought the people of Jammu and Kashmir and the PoK emotionally close as was witnessed during the ‘Heart to Heart Talks’ convened by the Panthers Party in 2005 and 2006 in Delhi. It is secular and the composite culture that has revived the hope for beginning a new era of understanding and reconciliation to give a positive support to the peace initiative between India and Pakistan, Harshdev remarked. As far democracy and rule of law is concerned, Harshdev said that ‘I have no hesitation to admit that it has been very sad and disappointing in the past and about the future I can not say any more’, he added. He gave the details how the Maharaja who acceded to India was humiliated, elected government dismissed in 1953, Pandit Prem Nath Dogra was denounced as communalist, Baskshi Ghulam Mohammed was humiliated and disgraced and lately Farooq Abdullah government was dismissed in 1984. He said ‘the rule of law was never respected or cared for and alleged that elections were rigged to demolish the voice of dissent. He said in 1988 Prof Bhim Singh won bye election to the Lok Sabha from Udhampur by a margin of 32000 votes but regretted that it was the Congress who could not digest that and fraudulently Bhim Singh was declared defeated. He questioned as to what happened to the Assembly election in 1987 when several new candidates of the MUF were declared defeated adding that most of them are leaders of terrorists in Pakistan today. Referring the recent incident where leader of the Panthers’ Legislature Party was thrown out of the Assembly on the first day of the session in Srinagar without recourse to the rule of law. Not only this, a lady office bearer of the party was assaulted with naked brutality by the police, leg of an advocate was broken after taking him in custody and a senior journalist was beaten and put in jail for four days. He said that this is the face of rule of law in Jammu and Kashmir. He said the tragedy of the causality of rule of law is that a motion served by the leader of the opposition was not even taken up during the rest of the session at the pleasure of the ruling party and most of the directions by the Apex Court have not been taken note of.. ‘This is the latest form of democracy in the state’ he grumbled. Strongly pleading to invoking of section 92 of the Jammu and Kashmir to disband the present government and the Assembly and holding fresh elections, the PP leader demanded immediate holding of delimitation of the constituencies which is mandatory under the Constitution
