SP in dock for torture

Jammu|Sep 6: For a change, looking beyond the routine course of corruption cases, the State Accountability Commission has taken a serious note of a case of worst kind of human rights violations at the hands of two senior police officers asking them to explain their position.
The case pertains to one Prabhakar Singh and Ghulam Rasool who were allegedly kept in illegal confinement in Chinore Police station and were mercilessly beaten up by Additional SP of Jammu Rural district Shakti Pathak and SHO of Chinore Police Station US Wazir.
The complainants submitted in the court that they were arrested without any complaint, lodged in the police station without registration of FIR and were subjected to third degree treatment including torture on their private parts.

The Accountability Commission has directed that the Notices be got served upon the Shakti Pathak and Wazir through DIG Jammu who shall nominate an officer not below the rank of an SP to serve the Notice upon the respondents.
According to the complaint the duo Ghulam Rasool and Prabhakar Singh were earlier also beaten up by the said SP Rural Shakti Pathak and SHO Police Station Ghrota mercilessly an d for which they have lodged a complaint before the Accountability Commission, where the complaint is in progress, the had also filed a criminal case before the CJM Jammu who had referred the matter to the Munsiff JMIC Ist Class Jammu for enquiry u/s 202 CrPC, the same is also going on. The next date in the Accountability Commission is 7.9.2007.
Therefore to pressurise, harass and under gross misuse of powers, to teach a befitting lesson to the complainants- duo the said SP Rural Shakti Pathak on 19.8.2007 came to the house of Prabhakar Singh at about 9.30 PM and started beating both the complainants, saying " Tum Police Par Case Karte ho, Dekhta hum mera koi kya bigar leta hai", and the SP Rural and his PSOs mercilessly beat up Prabhakar Singh and Ghulam Rasool in their house first and then took them to Police Post Chinore, while as the house falls under the area jurisdiction of Ghrota Police Station.
Both of them were handed over to the Incharge Police Post Chinore Mr U S Wazir who registered a false FIR u/s 510 RPC, at about 1.30 AM ( midnight ) as per copy of the FIR sent to the Court, and kept both of them in confinement.
No grounds of arrest were given to Prabhakar Singh and Ghulam Rasool in the said FIR no. 169/07, and nothing was depicted on the Notice board of the Police Station, Police Post or Distt Police Headquarters which is mandatory as per the Supreme Court guidelines.
Height of the things is that when a bail application was moved and report was sent to the Court, the Duty Magistrate ( Electricity Mobile Magistrate ) admitted the due to bail of Rs 5000/- and surety of the like amount and docket was issued by the Court, directing the I/c Police Post Chine to release both of them on bail. The same was served upon the I/C Police Post Chinore at 2 PM on 20.8.2007 but both of them were not released till ate evening.
The erring Police Officers have violated the Supreme Court Judgment giving guidelines on arrest and therefore are liable for administrative action and contempt of the Court.
The due have been so barbaric and mercilessly beaten by the Police that they have suffered bruises and wounds on their bums, their backs, their legs and private parts.
Prabhakar's eye too has been damaged in the Police beating, and same needs an immediate probe and action against the erring cops.
The Commission taking note of the submissions of the counsel of the complainants issued Notices to the respondents - SP and another and fixed the cases 1.10.2007.
