Principal Sessions Judge Jammu JR Kotwal today awarded seven years imprisonment to one Ghulam Nabi Shah alias Gamma alias Bansi Lal s/o Fazal Din r/o Pathwal, Tehsil and District Sailkote, Pakistan under 7/25 Arms Act and fine of Rs 5000.
According to the police case, Pak National Ghulam Nabi Shah was arrested near Shakuntla Theater Jammu on October 25, 1995 and a case was registered u/s 3 Enemy Agent Ordinance, Foreigners Act, 3/6 Indian Passport Act and 7/25 Arms Act and on the basis of his disclosure that he crossed over the border into the state along with the arms and ammunition during the night intervening October 24/25, 1995 and on the basis of his disclosure statements Arms and ammunitions have been recovered. Accused was sent to JIC Jammu for further enquiry, upon investigation it was found that accused is an activist of ISI of Pakistan and engaged in helping trained militants from Pakistan to cross over the border and also keeps on bringing arms and ammunition for disruptive activities and causing terror in the state. The accused arranged bomb-blast in MA Stadium on January 26, 1995 resulting into death of important persons. It was also found that arms and ammunition were recovered on the basis of disclosure statement and identification of the accused from village Kalalaian, RS Pura. The police recovered two AK 47 rifles, eight magazines, four hand-grenades, two pouches. The accused involved in bomb-blast was also facing trial in TADA. The bomb-blast case was under investigation by the CBI.
After entering Indian Territory on December 28, 1994 and committing disruptive activities including explosion on January 26, 1995, the accused had gone back to Pakistan and he entered into Indian Territory again during the night intervening October 24/25, 1995.
