HC orders to reinstate 'terminated' cop 9/5/2016 11:45:55 PM Early Times Report Jammu, Sept 5 : High court judge Janak Raj Kotwal today directed the respondents to forthwith reinstate in service the police cop who was terminated from duty after a detenue had allegedly escaped from his custody. The court directive came in a petition filed by cop Kafait Ullah, challenging his termination. Justice Kotwal, while quashing the inquiry report, observed that this was a fit case for terminating the disciplinary proceedings due to the inordinate delay in concluding the proceedings caused by unexplained delay of six years in providing the petitioner the copy of the inquiry report after the disposal. He allowed the petition on merit and quashed the entire disciplinary proceedings as also the December 7, 1998 report of the Inquiry Officer and directed that petitioner be reinstated in service forthwith. "However, in tune with the judgment of Supreme Court, he shall be paid 50 pc of the back wages keeping in view the fact that he has not worked in the department during this period.
