Bank loan recovery through alleged criminals
Court directs Gangyal police for necessary action under law

Jammu | Sep 22 - In a criminal complaint filed by one Nathu Ram s/o Sanji Ram r/o Kanji house Jammu against the Manager Citizens Cooperative Bank (CCB) Gandhi Nagar Jammu, Special Mobile Magistrate Electricity Jammu MK Sharma forwarded the complaint to the p/s Gangyal for necessary action under law.
The criminal complaint u/s 447, 452 r/w section 506 RPC was filed through Adv Anil Sethi in which it has been mentioned that the complainant, a reputed businessman obtained cash credit loan of Rs 25 lakhs from CCB, Jammu and executed a mortgage deed in favour of the bank.
On September 13, 2007 at about 12.00 noon a criminal looking team headed by the alleged accused Krishan Lal Sharma Manager Citizens CCB Gandhi Nagar forced their entry into the business establishment of the complainant at Kalu Chak Jammu and started using foul and abusive language against the accused in the presence of business associates and his employees, tenants. The manager was accompanied by about 10 persons who seemed to belong to the said bank and was fully abetting the alleged accused on commission of the above said offences. The accused was accompanied by gunmen from the bank. The gunman pointed his gun towards the complainant on the direction of the accused and the accused then threatened the complainant of physical elimination in case the complainant did not sign the already typed letter. The complainant felt so much harassed, humiliated and intimidated at gun point signed the said letter without actually reading its contents. This apart the accused forcibly put his hand in the pocket of the complainant and snatched away Rs 25, 000 which were lying in the pocket of the complainant.
The complainant before the Court pleaded that criminal proceedings may be initiated against the accused and he be tried and punished for the maximum permissible turn under law.
