HC directs Housing Minister to file personal affidavit, VC JDA to produce record
Allotment of Hall at Bahu Plaza Complex to CM’s brother challenged

Justice Hakim Imtiyaz Hussain today in petition challenging the allotment of hall/shop No 209 (A-2) South Block Bahu Plaza allotted illegally and arbitrarily to one Sajjad Ahmed Bhat brother of Chief Minister, directed Qazi Mohd Afzal, Minister for Housing and Urban Development Department, who is also Chairman JDA to file personal affidavit in the Court giving the circumstances under which the allotments were made after returning tender money to the petitioner Sunil Mahajan. Court also directed VC JDA that he shall produce the record pertaining to the allotment of shops on then next date of hearing.
Justice Hussain while considering the case in view of the issue raised, issued notices to the respondents, state through Commissioner/ Secretary Housing and Urban development department, Qazi Mohd Afazal Minister for Housing/ Chairman JDA, VC JDA, Secretary JDA, Collector JDA and Sajad Ahmed Bhat s/o Lt. Rehmat Ullah Bhat r/o Bhatindi opposite Dr. Farooq Abdhulla Ex-CM's Residence for objections. At this stage Adv SS Ahmed appearing for the petitioner informed the Court that the Government has cancelled the allotment impugned along with other allotments made in contravention of rules, upon this Court directed Commissioner/Secretary Housing & Urban Development to file affidavit and also file a copy of the order in case of any such cancellation has been made. Court further ordered that in the meanwhile no further proceedings in the matter be taken up till next date.
Sunil Mahajan s/o SK Gupta r/o 25/9 Trikuta Nagar Jammu has challenged the order No JDA/BP/2430 of August 30, 2007 whereby Sajjad Ahmed Bhat was allotted Hall/Shop No 209 (A-2) South Block, Bahu Plaza, Railhead complex Jammu, illegally/ arbitrarily by throwing established norms of allotment to the wind.
It has been further submitted in the petition that application of Sajjad Ahmed Bhat was entertained by the VC JDA solely for the reasons that he happens to be the younger brother of Chief Minister of the state Ghulam Nabi Azad and for this reason only the rules were thrown to winds to confer undue benefit upon the younger brother of the Chief Minister, petitioner alleged .JNF
