| Bahu Plaza become bone in neck | | Court asks Qazi to explain, summons record | | Early Times Reporter Jammu|Sep 26: Even though the Chief Minister Ghulam Nabi Azad ordered cancellation of 31 business premises in the plush commercial mall of Bahu Plaza following revelations that his brother got out of turn favour, the controversy is no way likely to die down as the High Court has sought details and circumstances in which this "expensive favour" was doled out. Beleaguered Minister for Housing and Urban Development, Qazi Mohammad Afzal, who has not been attending his office since early this month protesting the stripping of his Forest portfolio has been asked by the Court to file a personal affidavit. The court has also summoned entire record of the allotments to understand as why the tender money of the petitioner was rejected and the Chief Minister's brother was allotted the same business premises. The petition filed by one Sunil Mahajan through advocate Sheikh Shakil Ahmed clearly submits that the allottee Sajjad Ahmed Bhat was entertained by the Vice Chairman of the Jammu Development Authority and the Housing Minister solely on the basis that he was brother of the Chief Minister. Justice Hakim Imtiyaz Hussain while considering the case in view of the issue raised, issued notices to the respondents, including the Minister, the VC JDA and the allottee to file their state of objection till next date of hearing. Advocate Ahmed appearing for the petitioner informed the Court that the Government has cancelled the allotment impugned along with other allotments made in contravention of rules, upon this Court directed Commissioner/Secretary Housing & Urban Development to file affidavit and also file a copy of the order in case of any such cancellation has been made. Court further ordered that in the meanwhile no further proceedings in the matter be taken up till next date. It is further submitted that application of Sajjad Ahmed Bhat wasentertained by the VC JDA solely for the reason that he happens to be the younger brother of Chief Minister of the state Mr. Ghulam Nabi Azad and for this reason only the rules were thrown to winds to confer, undue benefit. Upon the younger brother of the Chief Minister,petitioner alleged. It is further submitted that a note prepared by VCJDA for the allotment on the basis of first come-first serve basis. The Minister for Housing also Chairman Board of Director JDA approvedthe allotment order in favour of younger brother of the ChiefMinister, which was challenged by the petitioner, seeking quashment ofthe said allotment on various grounds. Court today directed Minister,Commissioner Secretary Housing Dept to file affidavits.
