| Charges against EO framed in disproportionate assets case | | | Early Times Reporter Jammu | Oct 2 Special Judge Anticorruption Jammu, Kartar Singh, framed charges against Sham Lal, the then Executive Officer NAC Katra for possessing disproportionate assets to his known source of income to the tune of Rs 18, 76, 756.. The accused during the period from 1977 to December, 1995 acquired assets disproportionate to his known sources of income whereas the counsel appearing for the accused argued that the accused has income from hotel and other immoveable properties but the investigating officer has not considered the same and there is variation in his income from time to time but its benefit has not been given to the accused. Senior Public Prosecutor appearing for the VOJ said that VO has found the accused in possession large landed property, house at Katra, Hotel Swastik, Maruti Van and other immoveable assets worth Rs.18,76,756 which is much higher than the known source of income. Special Judge Anticorruption while framing charges observed that in the considered opinion of the Court all these points required determination during the trial of the case and they cannot be looked into at this stage. There is prima-facie evidence against the accused and it has been established by the investigating officer during investigation that the accused committed the offences and he has been found in possession of assets which are disproportionate to his known source of income. The accused is, therefore, charged for the commission of offence u/s 5(1) (e) r/w section 5(2) PC Act 2006 and sections 9/11/12/14 of the J&K Public Men and Public servants declaration of assets and other provisions Act 1983 and directed the prosecution to lead the evidence on the next date of hearing.
