| HC directs petitioner to surrender before Court for regular bail | | Fake PRC case | | Early Times Reporte Jammu | Oct 3 Justice Virender Singh of J&K High Court Jammu Wing in a bail application filed by one Mohd Yousuf for seeking anticipatory bail in FIR registered by P/S Rajouri u/s 420/467/466/468/471, 120-B RPC in making fake Permanent Resident Certificate in favour of one Harkanwar Singh s/o Manjeet Singh a non- resident putting up at village Bathuni, Tehsil, Rajouri, observed that the petitioner does not deserve the said concession as the same is being granted in exceptional circumstances and the present case is not of that category.. Justice Singh further ordered that in case the petitioner surrenders before the concerned Court and prays for regular bail, the same shall be decided at the earliest, may be on the same day, subject to the objections, if any, raised by the state with regard to his police remand The petitioner who is a clerk in the Revenue Department had issued a permanent resident certificate to Harkanwar Singh, a resident of Punjab, on the basis of which he got medical seat in ASCOMS. After hearing Adv KS Johal appearing for the accused and Deputy AG Mrs. Shaista Hakim appearing for the State and also concerned IO, who was present along with complete police file, Justice Singh observed that may be three co-accused of the petitioner have already granted the regular bail as stated by Adv Johal, that cannot in the view of the Court, be a ground for granting the relief of anticipatory bail to the petitioner as the yardstick for granting anticipatory bail is altogether different. Keeping in view the totality of facts and circumstances, the petitioner does not deserve the said concession at least, which has to be granted under exceptional circumstances.
