DB closes proceedings in PIL on functioning of private schools

In a much publicized petition filed in the year 2004 regarding the functioning of private schools, the Division Bench of J&K High Court Jammu Wing comprising Justice Virender Singh and Justice YP Nargotra finally closed the proceedings with the observation that in view of the order passed by Division Bench at Srinagar Wing in a PIL which was placed on record and the status report submitted by Director School Education as directed by the Court vide its order November 30, 2006, the DB is of the view that the present petition filed in Public Interest has served its purpose and no further order needs to be passed in the matter. If any grievances at all are left, that shall be looked upon by the respondents.
At Srinagar Wing, the Division Bench Comprising Justice Aftab Alam, Acting Chief Justice and Justice Nisar Ahmed Kakru, in a PIL regarding the functioning of private schools observed that the state counsel stated that not a single private school is running in the state without proper recognition by the Government and in case in future any unrecognized school is found immediate action will be taken against it. The statements to that effect are also made in the affidavits filed on behalf of Secretary Education and Directors of Education Srinagar/Jammu. Relevant legislation has also been made for control and regulation of all private educational institutions and the state accepted its responsibility to enforce the provisions of the legislation with regard to the private schools.
DB at Srinagar further observed that in view of the statements made in the affidavits filed on behalf of the state and submissions made by the counsel, the DB is of the view that this petition has served its purpose and no further order needed to be passed and consequently the proceedings are finally closed. Battery of lawyers appeared in these petitions at Jammu and Srinagar. JNF
