| Court acquits PF official caught red-handed by VOJ | | | Early Times Reporter Jammu | Oct 4 Special Judge Anticorruption Jammu Kartar Singh today acquitted one Satish Kumar Sharma Assistant, office of the Provident Fund Accounts Jammu, who was caught red-handed by the Vigilance Organization on September 24, 1999 and recovered Rs 1000- alleged bribe amount from the office register of the accused. According to the prosecution case a complaint was lodged by Mohd Shakeel r/o Mohalla Ustad Jammu in the Vigilance Organization alleging that on September 16, 1999, he approached the provident office for release of provident fund Rs 37702 and the concerned dealing clerk Satish Kumar Sharma demanded Rs 1500 as bribe from him for issuing check pertaining to the provident fund of the complainant. The complainant paid Rs 500 as first installment in presence of Bashir Ahmed and agreed to pay the second installment of Rs 1000 when he got the cheque of provident fund. On the written report of the complainant, FIR was registered and a trap was laid and accused was caught red-handed and search was conducted and the tinted money was recovered. Special Judge Anticorruption after hearing SPO appearing for the state and Advocates ML Thusoo and Pardeep Malhotra appearing for the accused and perused the record and the statements made by the witnesses, observed that that the statement of the complainant and prosecution witnesses are contradictory and there is yet another circumstances in the case which cannot be lost sight of. It is admitted case of the prosecution that the complainant lodged a written report in the VOJ on September 24, 1999. However, there is letter on the file which was written by SSP VOJ to the Deputy Labour Commissioner Jammu, requesting him to depute two Gazetted Officers to his office in connection with official duty on September 23, 1999. Upon this Court took serious note of the Vigilance Organization and further observed that it goes to prove that VOJ knew one-day prior of the occurrence that the complainant had to come and the raid was to be conducted though the complainant did not met VOJ people before September 24, 1999. In view of facts, it is held that the prosecution has miserably failed to prove the case against the accused beyond any reasonable shadow of doubt. He is acquitted of the charges farmed against him, the Court ordered. |
