| Further Investigation in Corruption case on the direction of Court | | VOJ presented Challan against SI and others | |
Jammu, August, 19 In a corruption case closure report was presented before the Court Special Judge Anticorruption Jammu. Special Judge Anticorruption Jammu in terms of order January 24, 2005 after recording afresh statements of complainant and other witnesses in the Court did not agree with the conclusion of the investigation and observed that “this is a fit case for putting delinquent officials on trial on charges of corruption, wrongful confinement and criminal misconduct besides ordering a probe against the then SDPO Reasi.”
The case was ordered for further investigation in the light of observations of the Court. During the further investigation, the statements of witnesses were recorded again and prima-facie allegations of corruptions were established against accused persons. The witnesses Hardayal and others deposed that they paid Rs 29,600/- as bribe on demand of accused Sham Lal the then ASI Incharge PP Poni now Sub-Inspector. Witnesses Daya Ram and others submitted that they paid Rs 6200/- on the demand as bribe to head-constable Madho Lal and after obtaining sanction to launch prosecution against accused persons, Challan was presented today in the Court of Special Judge Anticorruption Jammu u/s 5(2) PC Act 2006, 120-B, 161, 342 RPC against accused sham Lal, the then ASI Incharge PP Poni now Sub-Inspector of Police, the then Head Constable Madho Lal now rtd, Constable Ved Vyas the then posted in PP Poni and Tilak Raj Constable.
During the course of further investigation it was found that the accused persons demanded and accepted Rs 29,600/- and 6200/-. During enquiry by the SDPO Reasi, the accused persons returned Rs 25,300/- but Rs 10,500/- still have not been returned by them. According to the Challan on November 8, 1993 a complaint lodged by Suraj Parkash and others residents of Ghai Jagir, Godhar, Tehsil Reasi was received in the Vigilance organization in which the corruption charges were leveled against Sham Lal ASI and other accused persons. The complaint was sent to SSP Udhampur, who entrusted the same to SDPO Reasi for enquiry. The SDPO Reasi conducted enquiry and report was submitted to Vigilance Organization. A fresh Enquiry was also conducted in this organization. During the enquiry the allegation of corruption leveled against police officials prima-facie established and a case FIR No 90/94 was registered. During the course of investigation it was found that on September 5, 1993 Mrs. Suresh Devi w/o Bansi Lal committed suicide by jumping into Nallah, her dead-body cremated on September 6, 1993 by the villagers including her parent and in-laws. In this regard a case FIR 159/93 u/s 306, 498-A, 109, 201 was registered in P/S Reasi. The investigation was entrusted to Sham Lal ASI the Incharge PP Poni and assisted by others. The IO during investigation arrested husband and father of deceased. The villagers who were signatories to panchnama in P/P Poni, they were harassed and compelled by the Incharge to pay bribe and threatened with false implication an amount of Rs 35,800/- as bribe was demanded and accepted. The further enquiry by SDPO Reasi, they were asked to compromise on the basis that the amount will be returned to them and Rs 25,300 was returned. They were asked to sign some papers/affidavit which was later on manipulated to the effect that they denied the allegations. After completion of investigation a report was submitted COV where in the case filed was examined and it was decided to refer the matter for departmental action on the ground that complainant party remained changing their statements before SDPO and final report was produced before the Court of Special Judge Anticorruption Jammu, Court disagree with the closure report and directed further investigation, the Vigilance Organization after completion of the investigation presented Challan in the Court of Special Judge Anticorruption Jammu.
Special Judge Anticorruption Jammu Mr. JR Kotwal directed all accused person to furnish bail bond to the tune of Rs 10000/- each ad personal bond to the like amount. |
