| DB issues notice to the Chairman, others | | PIL against backdoor appointments in SBOSE | | Early Times Reporter

Division Bench of J&K High Court, Jammu Wing, comprising Justice Virender Singh and Justice YP Nargotra, in a Public Interest Litigation, filed by one Saroj Bala after going through the averments made in the petition and the other documents attached and in the absence of any one appearing for the petitioner, issued notice to Chairman, Secretary, Deputy Secretary Administration and Joint Secretary Administration with the direction to list this PIL after service of the respondents.
In the PIL it has been submitted that the respondent Board without issuing any advertisement notice in newspapers and without adopting due process of law for appointment against the posts regularized the services of some of the candidates illegally, arbitrarily, which is violative of Article 14 and 16 of the Constitution. It has been further submitted that some of the candidates have been appointed on consolidated basis and others on ad-hoc basis that too without advertising any post and without mentioning the grade to be drawn by the said candidates in the State Board of School Education and further alleged that aforesaid process of illegal appointments continue since 2005.
The petitioner prayed before the Court a CBI investigation into the appointments and regularization of the employees appointed in the J&K State Board of School Education from January 2005 onwards and also seeking quashment/orders for regularization issued after January 2007 as they are the backdoor appointments issued without advertisement of posts .JNF |
