| Court rejects bail of accused facing trial in NDPS Act | | | Early Times Reporter Jammu | Oct 17 Presiding Officer of TADA / POTA and 3rd Additional Sessions Judge Jammu Sanjay Gupta today rejected bail application of Hamid Ullah resident of Chanpura, Lal Nagar Srinagar presently lodged in Kot-Bhalwal Jail Jammu facing trial in NDPS Act. According to the challan presented at police station Akhnoor on August 10; during checking of vehicles police found the accused in possession of an attaché and from the attaché two kilogram charas was found. The accused was charge-sheeted u/s 8/20 NDPS Act. APP Mr. Gulzar Singh Charak while opposing the bail application stated that the punishment provided u/s 20 of NDPS Act is minimum 10 years and it may extend to 20 years. The accused has committed heinous offence as such he cannot deserve the liberty of bail. On the other hand the counsel for the petitioner submitted that the accused is in custody from the date he was arrested and challan has been produced against him. The applicant accused undertakes to avoid by all the conditions that may be imposed while granting bail.
The judge after hearing both the sides observed that prosecution has yet to produce evidence, at this stage there is no reasonable ground for presuming that accused is not guilty of the offence. The menace of Narcotic and Psychotropic Substances is causing great threat to the society and in case the persons who dealing with such like business are not dealt strictly, it will cause a great harm to society especially to young persons. With these observations Court disposed of the bail application and said that in the view of the Court accused should not be released on bail at this stage. JNF |
