| HC ordered attachment salary of Chairman and Managing Director Agro Industries | | | Early Times Reporter Jammu | Nov 3 Justice Nirmal Singh of J&K High Court Jammu Wing in a review petition filed by J&K State Agro Industries Development Corporation Limited against the judgment passed on September 6, 2007 in a petition filed Bhushan Lal Koul regarding release of his gratuity of an amount of Rs 2 lacs, has ordered that the salaries of the Managing Director and Chairman (happened to be Minister of Agriculture) J&K State Agro Industries Development Corporation shall remain attached. Court issued suo-moto notice to the respondents for initiation of the contempt proceedings. Chairman and Managing Director of the Corporation directed that they shall file their separate affidavits explaining as to how much expenditure they have received as TA/DA from the public exchequer. In case the affidavits are not filed within stipulated period, the Managing Director and Chairman of the Corporation shall appear in person on the next date of hearing. Justice Nirmal Singh after hearing Adv Mandeep Reen observed that perusal of the order reveals that there was direction that the respondents are free to withhold an amount of Rs 16000/- (dues towards Bhushan Koul) and the remaining amount is to be paid to the petitioner Bhushan Lal Koul with one month from the date of order. Two months are likely to expire but the respondents have not complied with the order passed on September 6, 2007 and Court Suo-Moto initiated contempt proceedings. In the review petition filed by Agro Industry in which it has been submitted that due to Financial Crunch they could not release the benefits to its employees. According to the Agro Industries that 110 employees have been retired within last five years and Agro Industry has not released pensionary benefits. Mr. Bhushan Lal Koul is one of employee had filed a petition in the state High Court in which the State High Court directed Agro Industries to release the pensionary benefits of the petitioner within one month. Against this order Agro Industries filed this review petition in the State High Court, in which Court ordered attachment of salaries of Managing Director and Chairman (happened to be Minister of Agriculture).
