| Appointment of 24 Accounts Assistant challenged | | HC directs respondents to file compliance report or appear in person | | Early Times Reporter Jammu | Nov 6 In a much publicized case of destroying selection record of Accounts Assistant from the office of SSRB, Justice Nirmal Singh of J&K High Court Jammu Wing directed Commissioner/Secretary GAD to file compliance report failing which he shall appear in person. In this much publicized case, 18 petitioners who appeared in the selection process in the year 1991 had challenged the selection/appointment of 24 Accounts Assistants in absence of record of selection which was according to the petitioners destroyed by the officer/official of SSRB. Justice Singh, after hearing Sr. Adv SS Lehar with Adv Nitin Bhasin appearing for the petitioners submitted that destroying official record is criminal act and respondents, who was custodian of the record, be penalized. The appointment of 24 persons without any record and without any basis cannot be justified especially under the circumstances when the petitioners were agitating for the last 16 years and seeking direction to the respondents to register a case against the persons responsible for destroying the record of selection of Accounts Assistants, Justice Singh said and observed further that there is no compliance report of order dated March 28, 2007. Respondents are directed to file compliance report within three weeks; in case the compliance report is not filed Commissioner/Secretary GAD shall appear in person on the next date of hearing, Justice Singh ordered.
