| Court Rejected anticipatory bail petition of accused involved in attack on Advocate | | |
Jammu, August, 21: Second Additional Sessions Judge Jammu Mr. AK Koul today dismissed the anticipatory bail petition filed by Bharat Sareen and Sumeet Sareen Ss/o Lt Sham Lal Sareen r/o Talab Tillo Jammu against whom a case was registered with the police station Pacca Danga Jammu for allegedly attack on advocate Vishal Sharma.
Mr. AK Koul after hearing Advocate AK Sawhney appearing for the petitioners and battery of lawyers appearing for the advocate Vishal Sharma and also perused the report, objections and CD File observed that as per police report petitioners appear to be involved in a case FIR NO 117/2006 of Police Station Pacca Danga Jammu. Actually case stand registered u/s 323/147/ 382 RPC but involvement of petitioners seems to be extent of section 323/147 RPC.
Second Additional Sessions Judge further observed that both these offences are bail-able and so no question of granting anticipatory bail does arise. But one thing is certain that indulgence of this Court in the manner sought, is not necessitated. With these observations Court dismissed the anticipatory bail petition as this petition is merit less.
It is worthwhile to mention here that on August 10, 2006, when advocate Vishal Sharma parked his vehicle near his office chamber Pacca Danga, the accused person’s whom scooter was parked their has abused the advocate without any reason when the advocate asked about misbehave, the accused persons attacked upon advocate and injured him. A case was registered in the P/S Pacca Danga Jammu and accused fled away from the spot. |
