| Abetment to suicide case’ | | Court rejects anticipatory bail application of businessman | | Early Times Reporter JAMMU | NOV 10 1st Additional Sessions Judge Jammu Mr. Puneet Gupta today rejected anticipatory bail application filed by Suman Mohan Bajaj s/o Mohan Lal Bajaj of Amritsar, Punjab, a businessman, allegedly involved in abetment to suicide committed by Naveen Handa and his lady servant Anu Bala in a local hotel on October 19, 2007. In the anticipatory bail application filed through Adv BL Chatha it has been submitted that petitioner/accused Suman Mohan Bajaj has nothing to do with the drastic step taken by Naveen Handa and Anu Bala and further submitted that the story revealed in the suicide does not appeal to the reason and it remains a mystery to blame a person who had given source of daily bread to Lt Naveen Handa while on the other hand APP Harpal Singh opposed the bail application and also produced the case dairy and submitted that the act of the petitioner accused claimed two lives. The allegation against the petitioner accused is grave and the petitioner accused is not entitled the concession of bail at this stage. 1st Additional Sessions Judge, after hearing both the sides and perusing the record, observed that applicant Suman Mohan Bajaj and one Ajit Singh have been arrayed as accused in a case registered u/s 306 RPC in P/S Nowabad. Two suicide notes are alleged to have been recovered from Naveen Handa and Anu Bala who are alleged to have committed suicide in a local hotel on October 19, 2007. Two suicide notes initially have roped petitioner and Ajit Singh in the case. It appears that some financial transactions had taken place between deceased Naveen Handa and accused Suman Mohan Bajaj. Two suicide notes found from the deceased make mention the harassment that has been caused to the victims by the act of accused forcing unfortunate victims to take extreme step to commit suicide. Statements of some of the witnesses have also been recorded who too have deposed regarding harassment by accused which made the victims to commit suicide. Upon this, Court said that investigation in the present case is still on and Court cannot comment regarding the conduct of the petitioner accused which made the victims to take steps of committing suicide. Court cannot brush aside the suicide notes especially of Naveen Handa in relation to the accused Suman Mohan Bajaj only for the reason that it speaks of financial harassment to which the victim allegedly is subjected to by the petitioner/accused. The gravity of the offence in which the petitioner accused is involved does not call for grant of relief of anticipatory bail to the petitioner/accused as such the petition for anticipatory bail is rejected and dismissed. |
