| Deceased committed suicide on Karvachouth | | Court rejects bail application in dowry death case | | Early Times Reporter Jammu | Nov 22 Special Mobile Magistrate, Electricity/ Sub-Judge, Jammu Mr. MK Sharma today rejected the bail application of one Darshna Devi arrested by the police in dowry death case. According to the prosecution case, Geeta Devi (deceased) d/o Mangat Ram committed suicide by setting her self ablaze in her matrimonial house at Village Pouni Chak on October 29, 2007 on the day of Karvachouth. The deceased was married to Ravi Kumar s/o Om Parkash r/o Pouni Chak Tehsil Jammu about five years back and out of this wed-lock there are two children. The husband of the deceased on the instigation of accused Darshan Devi used to harass the deceased for want of dowry. On the day of occurrence, the accused Darshan Devi teased the deceased that her parents have not sent anything on the festival of Karvachouth, getting frustrated persistent torture and harassment, unable to meet the repeated demands of dowry, the deceased committed suicide. The accused has been arrested a case u/s 306/498-A r/w section 120-B RPC was registered by the Police Post Pouni Chak. In the rejection order, Mr. MK Sharma, after hearing SPO DP Singh appearing for the Police and Adv Vandana Sharma appearing for the accused, observed that in the present case the deceased committed suicide of her married life only because she was tortured by her husband and her sister-in-law because she was not able to meet their persistent demand of dowry. The offence u/s 306 RPC is not an individual offence but it is an offence against the society which is punishable with imprisonment for 10 years. It is a serious offence and the concession of bail to the accused persons will encourage the perpetrators of such like offence and shake the confidence of people in the criminal justice. With these observations, Court disallowed the bail application. JNF |
