| If Pakistan walks away it loses its juridical locus for its presence in Kashmir | | | Self-Determination is a Shared Trust
Geneva, August 21: Saying that Pakistan Government of the day has a strict choice to either support the Kashmiri right of self determination under the constitutional arrangements with the people of Azad Kashmir or leave lock stock and barrel from Azad Kashmir and Northern Areas. JKCHR Secretary General Dr. Syed Nazir Gilani has said that any departure from the right of self determination entails an instant packing lock stock and barrel from Azad Kashmir and Northern Areas.
The minute the loyalty of the government of Pakistan to its avowed support of the right of self determination becomes suspect, Pakistan army does not have a juridical locus to remain here and it shall attract the label of an occupying army, he said.
President Musharaff and his government may feel free to violate the constitutional duty embedded in article 257 of the Constitution of Pakistan but that does not necessarily mean that the four Kashmiris, three living under three administrations on either side of LOC and the fourth the Kashmiri Diaspora living abroad have any reason to betray a 129 years old Rights Movement. In the last 16 years Kashmiris have lost a generation and suffered unprecedented violation of human rights, loss of dignity and property ever witnessed in the last 129 years. He said
It is unfortunate that Pakistan government which backed Kashmiri movement of its choice and making in the last 16 years has started using its tutelages to cause harm to self determination by spreading despondency. Self determination is a shared ‘Trust’ between all those who lost lives and those who are living. Every Kashmiri holds self determination as a ‘Trust’ for future generations.
He further said that Musharaff government is free to run away from its constitutional obligations accepted under UNCIP resolution in Azad Kashmir and Northern Areas. It would at least make one party less in the Kashmir dispute. However, over the years Pakistan and India have accrued a criminal liability for death and destruction in all the three administrations and we shall pursue the case of reparation against them.
Whether the Government of Pakistan supports or backs out from its self serving statements of supporting self determination, in all circumstances it carries a shared responsibility with the Government of India for rebuilding Kashmir. Both countries have massively exploited the natural resources embedded in Kashmir and unfortunately have deprived the Kashmiri people of any substantive benefit.Nazir said
Warning Kashmiris who are employed for running Pakistan supported Centers to refrain from selling a dangerous anti Kashmir product of the Government of the day.Gilani appealed all conscientious people in Kashmir to start preparing a dossier on these people because they remain criminally accountable for becoming engines of a disaster in Kashmir.) |
