Court awards nine years imprisonment to Pak militant

Principal Sessions Judge, Jammu, Mr. JR Kotwal, today awarded nine years imprisonment and fine of Rs 20,000 to Pak militant Mohammed Farooq code Abu Shamsher s/o Muneer Sher r/o Lalpura, Sialkot, Pakistan, who was arrested by the Army after day long encounter.
According to the case on December 30, 1997 the army received information about presence of militants in jungle of Village Siriala. They laid cordon on December 31, 1997 in the morning and came in contact with the militants. Militants also opened the fire in which one of Army Jawan got killed while another sustained injuries. Than army started search and captured the accused. One AK-56 and ammunition was recovered from the accused who was later handed over to police. In the encounter three Pak militants namely Abu Jabar, Abu Vikas and Abu Hazrat were also killed and one AK-56 Rifle along with two magazines were seized from the encounter site. According to the case the militants armed with sophisticated arms, bombs and ante mine explosives sneaked into Indian Territory at the instigation of Pakistan Intelligence Agency (ISI). However, the security forces in discharge of their official duty to apprehend them cordoned off the area and the accused Mohd Farooq was captured. The police after investigation registered a case against the accused u/s 302 RPC (murder), 307 RPC (attempt to murder) and 7/25 Arms Act.
Principal Sessions Judge, after hearing Public Prosecutor EA Tak appearing for the state and Adv Dinesh Verma appearing for the convict accused and also going through the case and arguments of both the sides, observed that the accused is undisputedly a foreigner and was found in Indian Territory with AK-56 Rifle in his possession at a place where an encounter had taken place between militants and the Indian Security Forces. The only reason that may slightly mitigate the severity of sentence to be imposed upon the accused is the long duration trial over nine years. In the considered view of the Court that sentence by way of imprisonment for a term of nine years and fine Rs 20,000 would be appropriate punishment in this case and as such the accused is sentenced u/s 7/25 Arms Act to undergo nine years imprisonment and fine Rs 20,000, in default of payment of fine accused shall undergo further imprisonment for a period of one year.
