| JDA officials in Vigilance net for illegal sale of plot. | | | Early Times Reporter Jammu | Nov 22 State Vigilance Organisation has registered a case under the relevant sections of Prevention of Corruption Act and RPC against Shri Sita Ram, then Sr. Assistant and Shri Kuldeep Kumar, Helper Jammu Development Authority for illegal transfer of a JDA plot allotted to Shri Satpal Sharma S/o Shri Mool Raj R/o Salan, Tehsil Hiranagar District Kathua to Shri Rajan Gupta S/o Shri Sain Dass Gupta R/o H.No.85, Sector 3, Nanak Nagar, Jammu by fabrication and tampering of records for pecuniary benefits. A Verification into a written complaint has revealed that under a criminal conspiracy Shri Sita Ram, Sr. Assistant and Shri Kuldeep Kumar, Helper of Jammu Development Authority (JDA) by fabricating a document, defalcation of records and misuse of official authority processed a case for transfer of ownership of plot No.5 phase 4 Paloura Housing Colony, Jammu measuring 16’.6” X 30’ from the original allottee Shri Satpal Sharma S/o Shri Mool Raj R/o Salan, Tehsil Hiranagar District Kathua to the complainant Shri Rajan Gupta S/o Shri Sain Dass Gupta R/o H.No.85, Sector 3, Nanak Nagar, Jammu for a consideration of Rs.20,000/-. The verification has revealed that the accused public servants Sita Ram and Kuldeep Kumar, being dealing hands with allotment of plots in the said colony, and having knowledge by virtue of their official position that the original allottee Shri Satpal Sharma, who was allotted the plot on 11.12.1995, had failed to deposit the premium amount of Rs.3195/-, hatched a conspiracy to illegally transfer the said plot to complainant Shri Rajan Gupta against consideration. The accused public servants fabricated a false document viz “agreement to sell” on November 2006, on behalf of original allottee Shri Satpal Sharma without his knowledge or consent to sell the said plot to the complainant and obtained Rs.20,000/- as part consideration from the complainant for the purpose. The premium amount of Rs.3195/- was also cleared by depositing the said amount without knowledge or consent of Shri Satpal Sharma, the original allottee. The verification has found that the suspect officials being fully aware that the original allottee had not paid the premium, deliberately and with mischievous intent, suppressed this fact when the list of defaulters was published by JDA in a newspaper on 25.07.2007. This was done to keep the original allottee away from these proceedings so that illegal benefit could be bestowed upon the complainant Shri Rajan Gupta against already settled consideration. In this manner the accused public servants in league with one another by acting in furtherance of the conspiracy and by abuse of their official position fraudulently and dishonestly conferred upon themselves undue benefit by receiving illegal gratification of Rs.20,000/- as part payment from the complainant Shri Rajan Gupta. SVO has registered Case FIR No.24/2007 under section 120-B, 468, 471 RPC r/w 5(1)(d), 5(2) J&K P.C Act P/S VOJ against Shri Sita Ram, then Sr. Assistant and Shri Kuldeep Kumar, Helper of Jammu Development Authority (JDA) and taken up the investigation. |
