Contractor's Xen hubby gets bail

Special Judge Anticorruption Jammu today granted bail to Executive Engineer BD Khajuria the then Executive Engineer PWD R&B Basohli, who had allotted works to his contractor wife at highly exorbitant rates and was arrested by the State Vigilance Organization on November 17.
In the bail application filed through his son Arun Khajuria in which Advocates DK Khajuria, KA Qazi, KS Charak submitted that petitioner is in custody since November 17, 2007 and he is not required for further interrogation because the relevant documents have been recovered from him. On the other hand CPO Parshotam Sharma appearing for the SVO submitted that petitioner is required for spot verification of the site, which is alleged to have allotted to his wife by him and as such he does not deserve concession of bail.
The Special Judge after hearing both the sides observed that perusal of the CD files reveals that the only allegation against the petitioner is that being an executive engineer, he allotted work to his wife, who is contractor by profession, at an exorbitant rates and thereby he abused his official position with dishonest intention and conferred undue benefit of lacs of rupees upon his wife and loss to the State Exchequer. The IO has seized all the relevant documents regarding allotment of work to the wife of the petitioner and now only those documents are required to be scrutinized. Nothing more is to be recovered from the petitioner.
That the FIR has been registered against the petitioner for the commission of offence under prevention of corruption Act with the allegation that he abused his official position and allotted the construction work to his wife. Only these allegations are required to be investigated in this case. Perusal of the CD file reveals that so far as disproportionate assets of the petitioner are concerned the preliminary enquiry is still in progress and it has nothing to do with the facts of the present case. With these observations Court granted bail to the peitoner on his furnishing bail bond and personal bond to the tune of Rs 20,000 each with the direction that he shall regularly attend the investigation for the next 10 days and shall make himself to the IO from 10:00 Am to 4:00 PM daily and thereafter as and when directed by the IO.
In the report submitted by the VOJ the following documents/cash has been recovered which was seized on the spot, cash worth Rs 78450/- seized from the house of the accused situated at Sanjay Nagar Jammu along with pass-books of different bank accounts/ bank lockers in the name of the accused and his family members, LIC policies of accused and his family members, documents pertaining to sale-deeds regarding the property owned by the accused. During the search of Govt quarter Basohli cashed Rs 70,000, LIC policies, Vehicle Scorpio JK02/1111 were recovered and seized.
