| HC declines to issue direction in Naib Tehsildars examination | | | Early Times Reporter Jammu | Nov 24 Justice Nirmal Singh of J&K High Court, Jammu Wing, in a writ petition filed by the employees of the revenue department who had appeared in the departmental examination for promotion of Naib-Tehsildar, which was later cancelled, declined to issue direction with regard to conduct of examination. The petitioners who are non gazetted employees of the revenue department working as Patwaries and Girdawars and had appeared in the departmental examination challenged the cancellation of the examination which was done on the ground of mass copying and unfair means. The case of the petitioners is that the respondents invited applications from the eligible candidates for appearing in Revenue Service (Executive) Departmental Examination vide notification issued on August 3, 2007, petitioners applied for the same and appeared in the said examination are sure to qualify the same. Now, respondents issued notification dated October 25, 2007 whereby the examination conducted in pursuance of notification August 3, 2007 has been cancelled on the ground of mass-copying and unfair means. Justice Nirmal Singh, after hearing Adv FA Natnoo appearing for the PSC and also perusing the minutes of meeting and report, said that it appears there was mass-copying and unfair means in the said examination. PSC has rightly cancelled the examination conducted by it. No case is made out by the counsel for the petitioners warranted interference by this Court. Sr. Adv MK Bhardwaj appearing for the petitioners submitted that the petitioners have apprehension to the effect that the respondents shall not conduct the Departmental Examination for a long time and result of the candidates, who have appeared in Srinagar wing, shall be declared and the successful candidates shall be promoted to the higher post. At this stage Adv Natnoo appearing for the PSC made a statement at the Bar that date for conducting Departmental Examination has already been notified and result of Srinagar and Jammu Wing shall be declared simultaneously. Justice Singh further observed that in view of the statement made by Adv FA Natnoo, no direction with regard to conduct of examination is required to be given. However, the petitioners are at liberty o participate again in the departmental examination to be conducted in the month of December by the respondents. JNF |
