HC stays proceedings pending before the SAC against Health Minister

Justice Hakim Imtiyaz Hussain of J&K High Court, Jammu Wing, today in a petition challenging the order of SAC issued on October 26, 2007 initiating proceedings against Pt Mangat Ram Sharma in the capacity as Chairman Khadi and Village Industries Board, ordered that the proceedings initiated against petitioner Mangat Ram Sharma shall remain in abeyance.
Pt. Mangat Ram Sharma Minister for Health and Medical Education had filed a petition in the State High Court seeking quashment of the proceedings initiated by SAC on the complaint of one Sajad Majeed for making backdoor appointments in the Khadi and Village Industries Board in which the complainant leveled allegations against officials of KVIB, including its Chairman, which was challenged by the petitioner Pt Mangat Ram Sharma.
Justice Hussain, after hearing Sr. Adv MK Bhardwaj along with Advocate Ajay Sharma and Ajay Abrol appearing for the petitioner and Adv SS Ahmed appearing for the respondent Sajad Majeed and also going through pleas raised in the present petition and allegations leveled by the respondent No 1 in the complaint before the SAC, observed that the present petition raises issues relating to scope and powers of the Accountability Commission. Issue whether the complaint falls within the allegations as defined u/s 2(3) and or grievances as defined u/s 2(9) of the Act also arise for adjudication. With these observations, the Court admitted the petition to hearing and issued notice to respondent which was accepted by the Adv appearing for the respondent. Court directed the counsel appearing for the respondent that he may file his reply within two weeks with an advance copy to the other side, rejoinder if any, within one week thereafter. Till next date before the Court order dated October 26, 2007 passed by the SAC impugned in the present petition and the proceedings initiated against the petitioner shall remain in abeyance. JNF
