Court rejects bail application in Hawala money case

Principal Sessions Judge, Udhampur, Mr. AK Shan today dismissed bail application of one Mohd Ismail s/o Satar r/o Dalwa Tehsil Gool District Udhampur, who was arrested by the Police on October 19, 2007 in connection with an FIR under unlawful activities (Prevention Act) along with Abdul Rashid and recovered Rs 1, 31, 900..
Principal Sessions Judge, after hearing Advocates GM Shan and Ranjeev Dubey appearing for the accused and Public Prosecutor GR Khajuria appearing for the State, observed that in absence of any change in fact, situation, if this Court grants bail to the accused it will bring into existence to conflicting orders on the same material which law does not permit as earlier the CJM Udhampur rejected the bail applications on the same grounds. It is suffice to say that case for the grant of bail to accused Mohd Ismail is not made out as such the bail application is dismissed.
According to the facts of the case the Police Gool on October 19 last received an information from reliable sources that Abdul Hamid, Mohd Ashraf Driver of Matador No JK02F-0721 and Mohd Ismail shopkeeper at Kantha Morh Gool and Abdul Rashid driver over ground workers of banned Hizbul Mujahideen (HM) outfit were operating in the area and are going to deliver huge amount to HM outfit terrorists operating in the area. On receipt of this information FIR u/s 10, 11, 1, 18, 20 and 21 of unlawful activities (Prevention Act) was registered in P/S Gool and investigation handed over to DySP Talib Hussain of Ramban.
During the preliminary investigation it was revealed that accused Abdul Hamid brought cash amounting Rs 1, 31, 900 from Kashmir and delivered the same to accused Mohd Ashraf driver at Sangaldhan, Gool. The said Mohd Ashraf as per the directions delivered the amount to accused Mohd Ismail at his shop which was recovered by the police on October 19, 2007, concealed in a rice bag. Four mobile phones were also seized from Mohd Ashraf driver, according to the investigation the cash was being delivered to Mumtaz Ahmed code Asif Commando, a commander of banned HM outfit terrorists operating in the Gool area.
