Railway Employee Cheating People for sending them America
Court awarded on year sentence and fine Rs 10,000/-

Jammu, August, 22: Special Municipal Magistrate Jammu Mr. Sanjay Parihar today convicted and sentenced to undergo imprisonment for one year and fine Rs 10,000/- for cheating people by assuring them to send America for this received huge amount from them.



In the present case accused Manmohan Singh an employee of the Railway presently posted at Delhi had made false promise to complainant Gandharv Singh that he will arrange that his son to America and by way of this false promise induced the complainant to part with an amount of Rs 1, 50,000/- along with original passport that the son of complainant will be send to America within one month and at the time of departure, the complainant would pay another amount of Rs one Lac to the accused and other amount 2.50 Laces when the son of complainant reached America. The said promise ultimately turned out to be false and accused flatly refuse to return the money back. Complainant lodged a complaint with the crime and railway police. The Crime and Railway Police after completion of the investigation presented Challan in the Court of law.



Special Municipal Magistrate Mr. Sanjay Parihar after hearing Sr. Prosecuting Officer Jawaid Ahmed Khawaja with Advocate HC Jalmaria appearing for the prosecution and Advocate Rajesh Tingloo appearing for the accused observed that the accused assured that he would be sent to America the son of complainant. Thus taking away of passport of Satyanarayan Singh by accused is proved, so it was for the accused to account for the whereabouts of the passport but in his statement accused had not said anything regarding taking away of passport. The document of passport was a valuable peace of evidence and once it was taken away by the accused and accused has not able to account for it, it would be presumed that either this document has been concealed by the accused or destroyed. Had it been recovered from the accused, it would have further lent more credibility to the prosecution case, which is otherwise proved. The accused held guilty for offence u/s 420/201 RPC, u/s 420 RPC he sentenced to undergo simple imprisonment for one year and fine of Rs 5000/- whereas for offence u/s 201 RPC accused is sentenced with payment of fine only of Rs 5000/- out of the fine of Rs 10,000/-, five thousand shall be paid to complainant as compensation. The accused convicted and sentenced after nine years investigation and trial.
