HC directs respondents to accept petitioners’ form , withhold results

Justice Nirmal Singh of JK High Court, Jammu Wing, in a batch of writ petitions challenging the age limit and time for filling application forms for the post of Prosecuting Officer in Police department has ordered that the petitioners can submit their applications forms on or before December 7, 2007 irrespective of the upper-age bar of 30 years provided the petitioners are not beyond 37 years of age. Court further directed respondents that they are at liberty to initiate the selection process but they will not declare the result of the petitioners.
This significant order has been passed in a batch of writ petitions filed by the petitioners who are practicing advocates challenging the notification dated October 25, 2007 whereby the age prescribed for the post of Prosecuting Officer has been fixed as 30 years instead of 37 years as prescribed under rules.
Justice Singh while allowing the plea of the petitioners observed that when the petition came up for hearing on November 14, 2007, it was ordered that status-quo with regard to the selection process shall be maintained. Additional Advocate General Mr. BS Salathia appearing for the State placed on record the order dated November 8, 2007 passed by the Srinagar Wing of the High Court and requested that in view of the order passed in the said writ petition, the status-quo order in the present writ petition may be modified so that respondents can initiate the selection process. Court taking consideration of the submissions of Mr. Salathia , Court ordered that respondents are at liberty to initiate the selection process but they will not declare the result of the petitioners and allowed the petitioners to submit their application forms on or before December 7, 2007 irrespective of the upper age bar of 30 years provided they are not beyond 37 years of age.
