Court rejects bail of alleged accused cheater, kidnapper

Munsiff Magistrate, Samba, Mr.AK Sharma rejected the bail application of Anil Kumar alias Sohan s/o Mulkh Raj r/o Amwal Tehsil Samba, who was arrested by Vijaypur police in a case u/s 343/366/376/420 RPC.
The Munsiff Magistrate, hearing Adv Subash S Sambyal appearing for the petitioner and Prosecuting Officer appearing for the police, observed that accused allegedly involved in very heinous crime and enlarging the accused on bail at this stage will surely send a wrong signal to the society and reasonable sufficient opportunity must be provided to the investigation agency to make the custodial investigation of the accused to unfold the mysteries. With these observations, the Court rejected the bail of the accused.
According to the police report on November 20, 2007, prosecutrix approached P/S Vijaypur with a written report alleging therein that her father-in-law had sold the property of her share for a consideration of Rs 10.60 lakhs and handed over money to her. Petitioner accused Anil Kumar and Vipin Kumar used to visit her house, Vipin Kumar was the ‘chela’ of Peer Baba Jogpur. Both of these persons after cheating her had taken of amount of Rs 16 lakh in installments. Accused Anil Kumar purchased two cars out of that money. They have told her that they will be refunding the money. On September 13, 2007, accused Anil Kumar came to her house and asked to her to accompany for getting the money and as such took her in car on the pretext of paying the money at Srinagar. He kept her in the confinement for the five days and committed rape upon her. On receipt of this report police registered the case and started investigation. During the investigation police has recovered the car and also arrested the accused on November 20, 2007 and the investigation is going on. During the course of arguments Adv Subash S Sambyal appearing for the accused submitted that a serious doubt upon the story put forth by the prosecutrix and said that the alleged occurrence of September 13, 2007 and the prosecutrix allegedly was kept in captivity and raped for five days while she has approached for lodging FIR after a period of more than two months. There is no explanation for the same. He has further argued that prosecutrix has filed a complaint in the women police station Jammu against her husband on September 21, 2007. Court after considering the facts rejected the bail. JNF
