| HC issues notice to the respondents | | Applied Arts Instructor challenges his attachment | | Early Times Reporter Jammu | Dec 5 JUSTICE Nirmal Singh of J&K High Court in a writ petition filed by Anil Saraf, Instructor Applied Arts IMFA Jammu, challenging his attachment, has issued notice to the J&K Academy of Arts Culture and Languages through its Secretary and others to show-cause as to why the petition be not admitted for hearing and granted four weeks time for filling objections. In the petition filed through Adv Jagjit Rai it has been submitted that petitioner Anil Saraf obtained loans for residential and personal purposes against his salary and income of his wife. The petitioner was paying installments regularly but due to some unavoidable circumstances, some installments could not be paid and the bank served a notice for demanding installment. In the petition it has been further alleged that respondent stopped the salary of the petitioner merely on the notice of demand issued by the bank whereas the case is still pending in the Bank Court. It is further alleged that the petitioner was attached at Kalakendra Jammu which is not a statutory body, the respondent No 1 further issued an order of attachment of the petitioner with the Additional Secretary J&K Academy. The petitioner challenged both the orders of attachment as violative of Service Rules. JNF |
