| Lady involved in abetment to suicide denied bail | | | Early Times Reporter Jammu | Dec 8 2nd Additional Sessions, Judge, Jammu Mr. Ashok Kumar Koul, today rejected the bail application of Darshna Devi w/o Bodh Raj r/o Pouni Chak involved in abetment to suicide. On a written report lodged by one Mangat Ram father of the deceased Geeta Devi, it has been stated that his daughter was married to one Ravi Kumar since last five years, two children were born, eldest of four years and youngest only of two months old. The deceased was being ill-treated by her husband and he would indulge in physical assault even at the instigation of his sister petitioner Darshan Devi. Ultimately on October 29, 2007, deceased was on fast on account ‘Karvachauth’ when her husband at the instigation of his sister (petitioner) assaulted her, leaving her with no option but to commit suicide by putting herself on fire. A case was registered and accused was arrested. 2nd Additional Sessions Judge, after hearing Adv KS Pathania appearing for the accused/petitioner and APP Ravinder Sharma appearing for the state, observed that petitioner is stated to be involved in a grave crime and the evidence collected so far and the facts suggested her involvement and enlarging her on fail, being a woman, would be unfair. The justice finds itself in quandary as deceased must be crying for justice from the grave and her minor children from their home, whom the deceased has left behind, the Court observed adding that children have been deprived of the affection of their mother forever and who can compensate them for the last suffered by them. After all bail is not a bonanza which can be given to anyone in any situation. Once the charge is serious, supported with convincing evidence, it matters least whether investigation is complete or not. Generally, rule is bail and refusal an exceptional, but the facts of this case are suggestive that this case falls under exception and so prayer for bail deserves to be declined as such the petition is rejected, the Court ruled.
