| Court awards 6 yrs RI to SRTC Employee, 2 yrs to Mill owner | | Food grain scam | | Early Times Reporter Jammu | Dec 8 Special Judge Anticorruption, Jammu, Mr. Kartar Singh, today awarded six years rigorous imprisonment to Romesh Kumar the then Driver SRTC and two years to Bansi Lal owner of Shamboo Flour Mills RS Pura in a misappropriation of 96 bags of wheat, which took place in 1999. Special Judge Anticorruption after hearing CPO Mr. Purshtom Sharma appearing for the VOJ and Adv RP Sharma appearing for the driver and Advocates DN Gupta and BM Gupta appearing for the mill owners and considering the facts of the case observed that prosecution has succeeded in proving that accused Romesh Kumar committed the offence of criminal misconduct by dishonestly misappropriated the consignment of wheat entrusted to him and as such he is guilty of offence U/Ss 5(1) (c) r/w section 5(2) PC Act 2006 and 409 RPC and 120-B and he is convicted u/s 5(2) PC Act 2006 and sentenced to undergo RI for a period of two years and fine of Rs 5000 u/s 409 and he is further convicted and sentenced to undergo RI for a period of two years and fine Rs 5000 and two RI and fine of Rs 5000 for section 120-B RPC whereas accused Bansi Lal is convicted u/s 120-B RPC and sentenced to undergo RI for two years and fine of Rs 5000. Court further ordered that the sentence shall run concurrently. The accused persons who were present in the Court were taken into custody and sent to the district Jail Jammu to serve out the sentence impose upon them. According to the prosecution case the VO received a reliable information on September 17, 1999 that Romesh Kumar, truck Driver of SRTC in connivance with officers/ officials of Food and Supplies Department, by abuse of his official position, has sold the consignment of wheat meant for food and supply store Banihal, at RS Pura for pecuniary benefits causing huge loss to the state exchequer. During the investigation it was found that Romesh Kumar had left for Banihal with consignment of wheat on September 15, 1999, however, the investigating officer located the house of the suspect in Resham Ghar colony and found the truck empty parked outside his residence. The IO seized the truck and arrested the accused Romesh Kumar. On the disclosure of Romesh Kumar, 96 bags of wheat recovered from one room of mill owned by Bansi Lal. After completion of the investigation challan was presented in the Court. |
