| Court summons Gopal Sharma | | | Early Times Reporter Jammu | Dec 19 Making out a case of contempt for willfully disobeyed the court orders, the Jammu and Kashmir High Court today summoned for personal appearance the former Director General of Police Gopal Sharma, who is now the Director General of Special Service Bureau (SSB). Observing that a case of the contempt of court prima facie figures out against Sharma, the Judge has sought his personal presence in Court before proceeding further in the case. The High Court Registry has been asked to send a notice to the present DGP for its service to Sharma. This direction has been passed by Justice JP Singh in a contempt petition filed by Balkar Singh and others seeking directions against the respondents to consider them for out of turn promotion because of their having been recommended for such distinction by the Supt of Police Kathua. This petition was disposed of on May 31, 2002 by issuing directions to consider the claim of the petitioners' accordance with the rules. Petitioner's case was however again rejected vide order January 11, 2003. Aggrieved by this order filed yet another petition which was disposed of on February 12, 2004 with a direction to re-examine the case of the petitioners for their out of turn promotion and quashed the order dated January 11, 2003. The Director General of Police vide order dated April 21, 2005 had again rejected petitioner's case for out of turn promotions. This order of the DGP, the petitioners stated that is in willful disobedience to the directions which had been issued by the High Court on February 12, 2004. Respondents were directed to file statements of facts. Although order passed by the DGP indicates that this Court had issued a direction to consider the case of the petitioner on the analogy of promotions granted to other police officials who were members of the teams involved in anti-militancy operations for killing foreign militants, yet there is not even a whisper in the order as to whether he had considered the case of the petitioner on the analogy of those who were members of the teams which were involved in anti-militancy operations conducted for killing foreign militants and were granted out of turn promotions. Justice JP Singh after hearing Adv Sunil Sethi appearing for the petitioners and AAG BS Salathia appearing for the respondents observed that in these circumstances the Court prima-facie of the view that respondent Gopal Sharma Ex-DGP has willfully disobeyed the direction issued by this Court and proceedings in contempt are required to be initiated against him. However, before proceeding further in the matter, a notice is required to be issued to him to appear in person and explain as to why contempt of Court proceedings be not initiated against him. |
