Installation of stone-crusher by MLA’s son challenged
HC ordered maintain of status-quo

Justice Hakim Imtiyaz Hussain of J&K High Court Jammu Wing today in a petition challenging the private respondents who were going to install a stone-crusher, a mixer plant and a bitumen concrete (Asphalt plant), has issued notice to respondents and directed Chairman Pollution Control Board to file objections. The court also directed that in the meanwhile the status-quo should be maintained.
In the petition filed by the inhabitants of village Sangani Barola through advocate Surinder Kour challenging the installation of stone-crusher, mixer plant and bitumen concrete (Asphalt plant) by the son of MLA Akhnoor stating that the crusher will through dust all around the area which can prove injurious to the health of the villagers and sound of crusher will disturb the population particularly school going children. Inspite of representation of the inhabitants of the village the tehsildar had issued no objection certificate as private respondent Ankush Sharma was son of an MLA, Sham Lal Sharma and nephew of a member parliament who are influential persons. Even the commanding officer of infantry division has written a letter to district collector Jammu that a stone-crusher plant was being established in village Sangani Tehsil Akhnoor consisting of 200 families. The site of setting-up of the crusher lies within the safety distance of ammunition point which is not permitted and against the safety norms. Frequent visit of unauthorized persons in and around the vicinity of Army parameter is posing serious security threat. The Chairman Pollution Control Board Jammu had given No Objection Certificate to the private respondents and they have started installing stone-crusher etc and it will cause health hazard which is against the provision of law.
During the course of argument Adv Surinder Kour submitted before the Court and seeking quashment of the order issued by the Chairman Pollution Control Board in the shape of NOC in favour of private respondents to install stone-crusher and other plants in village Sangani Barola Tehsil Akhnoor and also seeking direction to the respondents for restraining the private respondents Mr. Ankush Sharma and Gulshan Kumar from installing stone-crusher and other plants in the village and also seeking direction to respondents to strictly follow the provisions of law for installation of stone-crusher and other plants in Village Sangani Barola. Court after hearing the counsel for the petitioners ordered to maintain status-quo. JNF
