| Youth Died in Alleged Army Custody | | Magisterial Enquiry held responsible Militants | | .Jammu, August, 23:- In a much publicized custodial death of one Ghulam Ali s/o Nisar Khanji r/o Dugga Tehsil and District Doda, who allegedly died in the Army Camp on August 2, 2005, the inhabitants started agitation seeking probe in the death of youth, the District Magistrate ordered Magisterial Enquiry and appointed Mr. JA Zargar KAS Additional District Magistrate Doda to conduct magisterial enquiry in the circumstances led to the death of Ghulam Ali. The enquiry was started on September 11, 2005 and submitted its report on October 31, 2005 to the Commissioner Secretary Home and other High Officials. The Additional District Magistrate Doda during the enquiry recorded statements of 15 witnesses including two army personals, who brought Ghulam Ali from the forest to Army Camp.
During enquiry the Additional DC recorded the statement of witnesses including real brother of the deceased and one Ghulam Hussain claims to be an eye-witness submitted that on the day of July 30, 2005, he had gone towards Nagni Jungle while reaching near Nagni, he saw Ghulam Ali in very serious and unconscious with multiple injuries. On seeing Ghulam Ali in such a condition, Ghulam Hussain to help him regaining his conscious brought some water and made him to drink due to which Ghulam Ali regained conscious on being enquiry he narrated the whole story to Ghulam Hussain. According to Ghulam Hussain, Ghulam Ali had told him choked voice that some persons in Army Uniform brought him at Nagni and started asking him about the location of Army basis and charged him with the allegation of being the source of army but Ghulam Ali refuted the allegation that he has ever acted as a source of army but the militants did not agree with him and started inflicting injuries on various part of his body till he become unconscious. He further submitted that while he was in the process of helping Gulam Ali to standup, the jawans of army who were on patrol duty saw them and enquired about the matter and on seeing the condition of Ghulam Ali, the army jawan brought both of them to army camp located at Bhagwah where Ghulam Ali was given first Aid and he was subject to questioning and during that course Ghulam Ali breathed his last on August 2, 2005. He further submitted that at the time of death of Ghulam Ali, he was there in the army camp and he had informed the villagers about the fact of the case.
The statement of the army personals who had brought Ghulam Ali from Nagni corroborates with the statement of Ghulam Hussain. In view of the statement of the persons recorded and in reference to the opinion of the doctors, who conducted post-mortem, it appears that Ghulam Ali had been subjected to cardiac arrest due to severe thrashing and Multiple injuries on his body by the ANEs, which ultimately become the cause of death of Ghulam Ali. The Evidence adduced suggested that certain ANE’s in Army Uniform had committed the heinous crime of abducting and thrashing a poor man like Ghulam Ali deceased which ultimately become the cause of his death. In the concluded para of the enquiry report the Additional DC Doda said that it is unfortunate that precious life has been lost by an act which never be justified and is totally dis-regretful of the true value of human life and submitted his report to the Higher Authorities of the state. The Higher Authority after considering the report on August 21, 2006 directed Crime and Railway Police to register a case and started investigation in the case. The Crime Branch reregistered a case u/s 302/364/34 RPC.
