| Contempt case against MM Bhat | | HC seeks presence of then Commissioner Education in Court | | Early Times Reporter Jammu | Jan 5 Justice JP Singh of J&K High Court, Jammu Wing, in a contempt petition filed by petitioner Dev Raj and Ors, directed Deputy Advocate General, appearing for the education department to produce MM Bhat, the then Commissioner/Secretary to Government Education Department, before this Court to explain as to why contempt proceedings be not initiated against him for willful disobedience of directions issued by this Court on December 21, 2004 with the direction to registry to list this case in second week of February, 2008. After hearing Adv Abhinav Sharma appearing for the petitioners and Deputy AG Mrs. Neeru Goswami appearing for the education department, Justice Singh observed that in terms of the judgment passed by this Court in a writ petition dated December 21, 2004, petitioner’s case for promotion was required to be considered in accordance with the common seniority of teachers. Respondent Commissioner/Secretary Education Department, had issued Government order on May 15, 2006, acting contrary to the directions of this court and rejected the case of the petitioner by considering the seniority lists of only male teachers and he is accordingly found prima-facie guilty of disobedience of the directions issued by the Court on December 21, 2006 and directed Deputy AG to produce MM Bhat in the Court.
