| Consumer Commission directs Insurance Co .to pay Rs.6 lakh to petitioner | | ‘Directs departmental inquiry against delinquent officials’ | | Early Times Reporter Jammu | Jan 10 Disposing off a complaint lodged by one Jawahar Lal Bhat of Kilam Anantnag, presently at Model Town Gangyal, against the United India Insurance Company for denying the insurance claim of his residential house which was gutted in a fire in 2001, the Jammu and Kashmir State Consumer Disputes Redressal Commission, headed by Justice (Retd) GD Sharma with Khalid Hussain as its member, has directed the respondent Insurance Company to indemnify the complainant to the extent of total loss suffered by him which extends to the insured limit of Rs. 6 lakhs. The Commission directed that the amount should be paid along with interest @ 6 per cent per annum from the date of loss i.e June 25, 2001 till the final payment is made along litigation cost of Rs.6000. The Insurance Company is also directed to conduct a departmental inquiry regarding the unfair repudiation and fix responsibility to recover the amount of interest from the pay of the delinquent (s) dealing official(s).The Commission observed that public money of banafide depositors can not be allowed to be squandered to cover up the misdeeds of the delinquent officers of the company. Referring to the appointment of R A Shah by the Opposition party to conduct the preliminary survey is shrouded in mystery as no intimation thereof was given to the complainant, the Commissioner observed and maintained that the said surveyor took no steps to associate the complainant while conducting the inquiry. The Commission further observed that the said surveyor has not acted in impartial and fair manner but his conduct shows that he was in league with the then dealing Branch Manager of the Company to fabricate false report in order to deprive the complainant of his legitimate claim. |
