| Ration supply stopped to dealer under MLA’s pressure | | HC directs to consider the enquiry report for restoring supply | | Early Times Reporter Jammu | Jan 12 Justice Hakim Imtiyaz Hussain of J&K High Court Jammu Wing in a petition seeking uninterrupted supply of ration to a dealer at Marmat, which was stopped by the Deperment under the pressure of concerned MLA, directed respondents that they shall consider the enquiry report of October 11, 2007 for restoring supply of ration/sugar to the petitioner. Court, after hearing Adv AM Malik appearing for the petitioner, issued notice to State of J&K through Commissioner/Secretary CAPD, Director CAPD, MLA Abdul Majid Wani, Joint Director Administration CAPD, Assistant Director CAPD Doda and private respondent Javid Iqbal with the direction to registry to list the case on February 5, 2008. The counsel for the petitioner during the arguments said that Assistant Director CAPD Doda on October 11, 2007 made a communication to Director CAPD regarding the restoration of ration supply in favour of the petitioner whereby it disclosed by the respondent that there is a family tug of war between the petitioner and private respondent. The private respondent has managed to become a dealer for two months in the year 2003 and that order was challenged by the petitioner in the court and the order impugned was stayed and ration supply was again restored to the petitioner and prayed before the Court for issuance of direction to the respondents to restore the ration supply to the petitioner based upon de-novo enquiry conducted by Assistant Director CAPD Doda whereby the said respondent has proposed to restore back the supply of ration to the petitioner for Behota (Marmat).
