| SASB not answerable to legislature | | | Early Times Reporter Jammu | Jan 14 The Shri Amarnath Shrine Board has refused to share details with the legislature citing its autonomous status and overall supervision by the Governor who, in this case, is not advised by the Council of Minister. A written question had been listed in the Legislative Council today about a case pertaining to Sewa Committee Baradarn and others versus the state of Jammu and Kashmir. In reply to the question, the Minister read out a communication of the Chief Executive Officer of SASB that the board is not a controlled corporation and is autonomous in nature. Giving reply to a question by Syed Basharat Ahmad Bukhari, the Minister told the House as per the communication made by Deputy CEO, Shri Amarnath Jee Shrine Board in the case Sewa Committee Baradarn and others versus the state of Jammu and Kashmir it has been held "We have, no hesitation to hold that the Board is not a controlled Corporation within the meaning of Article 12 of the constitution". It has further held that "the Governor is sovereign ex-officio holder of the power who acts on his personal satisfaction and not on the aid and advice of the Council of Ministers. The exercise of control and powers the Act is distinct and different from those exercise formally in his name for which responsibility rests only with his Council of Ministers headed by the Chief Minister". He added that the Board further informed that Shri Mata Vaishno Devi Shrine Board is not a controlled corporation of the state but an autonomous body headed by the Governor. |
