| Multicrore Carriage Food-Grain Contract of FCI Challenged | | HC Declined to quashed Technical Experience Clause | | Jammu, August, 24:- Justice YP Nargotra of J&K High Court Jammu Wing today in a writ petition filed by M/S JK Flour Mills Private Limited seeking quashment of work experience clause of the tender notice issued by the regional officer Food Corporation of India for carrying food-grains, observed that in the present case the pre-qualification condition prescribed is that tenderer should have executed atleast a contract of value not less that 50% of the estimated value of present contract in the preceding three years. The said condition cannot be said to be unreasonable. It is not the case of petitioner that this clause has been incorporated by the respondents in malafide exercise of administrative power vested in it. No ground has been made out by the petitioner to show that the said clause in any manner is arbitrary in nature or suffers from unreasonableness. With these observations, Court dismissed this petition as there is no merit and also discharged caveat. |
