| Consumer court directs company to pay 8.17 lakh to complainant | | | Early Times Reporter Jammu | Jan 17 Jammu and Kashmir Consumer Disputes Redressal Commission, headed by Justice G D Sharma with Khalid Hussain as Member, has decided a complaint instituted in the Commission on December 11, 2006 and directed the respondent Bamba & Co Ltd Kanak Mandi Jammu and others to pay Rs.8,17,840 to the petitioner which was due on December 11,2006 along with the interest on the principal amount of Rs.6.50 lakhs @ 10 per percent per annum till the final payment is made besides litigation charges of Rs.5000. Rajnesh Dachan son of late R. Dachan of Channi Himaat, Jammu, at present USA, filed a complaint through his mother as Special Power of Attorney of Usha Dachhan against Bamba and Co Ltd Kanak Mandi Jammu and others alleging therein that the company had failed to pay him the monthly installment of interest on Rs.6.50 lakhs initially deposited with the company while the last installment was paid on December 24, 2004 After hearing both the sides and perusing the records and the evidence, the Commission observed that the complainant had deposited the principal amount of Rs.6.50 lakhs and payment of interest was being at the rate of 14 per cent per annum. The last payment was made in the month of December 2004 but that singular payment was not from the interest accrued on the principal amount but Rs.5000 had been deducted from the principal amount itself. It has thus transpired that last payment of the interest was made in the month of July 2004 in the sum of Rs. 5960. It is thus a proved case of deficiency in service as defined in section 2 (g) f the Jammu and Kashmir Consumer Protection Act on the part of Ops. In the light of these observations, the Commission accepted the complaint and directed Ops to make payment to the complainant to the tune of Rs.8, 17, 840 which was due to the complaint as on December 11, 2006 along with the litigation charges. |
