| Accused involved in kidnapping of minor girl granted bail | | | Early Times Reporter Jammu | Jan 19 Chief Judicial Magistrate Jammu Mr. Sanjeev Gupta granted bail to Ajay Sharma of Shakti Nagar Jammu, who was arrested by the Bakshi Nagar police. According to the police case a minor girl was kidnapped by the accused Pawan Kumar and Deepak Sharma alias Vishu on December 4, 2007 and was taken to a room in Gangyal where she was kept in illegal confinement and was repeatedly raped by them till December 28, 2007. The police report further reveals that accused Ajay Sharma also visited that room and committed rape on the girl, who succeeded in giving slip to the accused and returned back to her house and narrated the occurrence to her mother who filed an FIR in the police. During the course of the investigation statement of minor girl was recorded u/s 164-A Cr PC, besides her parents. The statement reveals that she had implicated Vishu Sharma and Pawan Kumar as persons who had forcibly sexually molested her repeatedly during the period she remained in their illegal custody but has not uttered a word regarding rape upon her by accused Ajay Sharma. CJM, after hearing CPO for the State and Adv Anil Bargotra appearing for the accused, held that counsel for the accused has urged that statement of the girl recorded in the Court on oath excludes the complicity of the accused Ajay Sharma in the crime irrespective of fact that she was named during the course regarding her statements u/s 161 Cr PC as such he may be admitted to bail. After carefully going through the statement of the girl recorded u/s 164-A Cr PC, it becomes clear that there is not whisper in the said statement about the involvement of accused Ajay Sharma to the sexual molestation of the girl. With these observations, CJM granted bail to the accused provided he furnishes bail bond and personal bond to the tune of Rs 20,000 with the condition that he shall cooperate with the investigating agency and appear before the IO as and when directed.
