Special Tribunal directs VOJ to register case against Mutating Officer

Judicial Member of J&K Special Tribunal Jammu Mr K Kapoor in a land scam worth crores of rupees, has directed Vigilance Organization that a case be registered against concerned mutating officer for proper investigation and a charge-sheet presented in the Court of law against the defaulting officer of the relevant time who were party to unlawfully changing the record and fabricated the same converting uncultivable into cultivable land.
This landmark direction was passed by J&K Special Tribunal in an appeal filed by Noor Mohd r/o Chawadi against the judgment of Joint Commissioner Agrarian Reforms who set-aside the mutation attested by the Revenue Authority. Joint Commissioner in his judgment directed enquiry against the officers involved in changing the nature of land and said that under Khasra No 345 min measuring 181 Kanals 16 Marlas is Gair Mumkin Khad and has been recorded as such even in Jamabandhi record of 2000-2001 (BK), the nature of the land this cannot be changed by virtue of a few girdawari entries and that too with respect to a particular tract of the land up to 10 kanals in this case. Against this order the appellant filed appeal in the Special Tribunal J&K.
Judicial Member, after hearing Adv CM Gupta appearing for the appellant and Adv BD Sundan for the respondents, dismissed the petition with the direction to Vigilance Organization to register a case against the concerned mutating officer for proper investigation and observed that the intention of the authorities/ officials speak volumes that the value of this land has assumed sky racketing price as a number of unscrupulous real estate people are getting the ownership of the land transferred to themselves and later vending the same at their choice price and also ordered that a copy of this order be furnished to the Vigilance Commissioner for registering a case and initiate proper investigation against the defaulting officers/ officials. In fact, "I have been encouraged to pass this order on account of sordid state of affairs in which a piece of 10 Kanals of Shamlat Deh Land, which is of the kind of the Gair Mumkin Khad has been recorded as cultivable land only in order to give undue, unlawful benefit to the petitioner for which the Joint Commissioner Agrarian Reform had ordered enquiry to be conducted by the Tehsildar Settlement Jammu, but it appears from the record that nothing has so far been done and ordered that a copy of this order be sent to the Deputy Commissioner Jammu for seeking explanation of the concerned Tehsildar (settlement) Jammu as to why he has not conducted enquiry as ordered on March 18, 2005 and the explanation may be forwarded to the Vigilance Commissioner with copy to this tribunal for record.
