| SC grants 8 weeks time to Union of India to file reply | | Release, deportation of PoK, Pak detenues case’ | | New Delhi | Feb 1 A Division Bench of Supreme Court of India, comprising Justice B N Agrawal and Justice G S Singhvi today granted eight weeks to the Union of India to file a detailed reply to the rejoinder filed by Prof Bhim Singh in connection with a writ petition seeking immediate release and deportation of nearly 100 PoK and Pakistan detunes languishing in different Jails in the country for several years under Jammu and Kashmir Public Safety Act. The State Legal Aid Committee in a handout said that the Supreme Court has directed the Union of India to depot PoK and Pak detenues who had completed their sentence in jails and were no longer required by the Government of Jammu and Kashmir. Though the Jammu and Kashmir Government in pursuance to the earlier directions of SC had recommended deportation of some of the detenues, the Union of India in its reply challenged these directions as the Apex Court had on September 28, 2007 directed the State of Jammu and Kashmir to make fresh recommendations in respect of six foreign nationals including Mohammed Ashraf (Arif Choudhary @ Cobra), Shabir Ahmed code Lakman, Qasim Mehmood code Mohsin Khan, Sajad Ali Jat code Sajad Bhat, Mohammed Abdullah @ Abda Murad and Shahid Latief code Chota Shahid. In the same judgment the SC had quashed the prosecution of Raza-ul-Awan, Mohammed Ussman Sheikh, Mohammed Farooq Raja and Qudrat Ali directing the state to recommend their names to Union of India for deportation. In his rejoinder Prof Singh strongly refuted the claim of the Union of India urging the Supreme Court to take serious note of the hostile attitude of the Centre challenging the supremacy of the order of the Apex Court. B S Billowria, Manjoor Ali and Ritu Puri appeared in the petition while Union of India was represented by Amrindra Saran, Additional Solicitor General Government of India, the handout added. |
