Chief Judicial Magistrate Jammu Mr. Sanjeev Gupta today rejected the bail application of Anil Singh of Chowadhi, involved in attempt to rape with a 7 year old girl.
In the bail application the accused submitted that he is innocent and has not committed any offence. Upon this Court called the report from the concerned police which reveals that a case for offence u/s 376/511 RPC (attempt to rape) has been registered against the accused who has been taken into custody on January 20, 2008. CPO Mr. MA Manhas has filed the objection and opposed the grant of bail on the ground that the accused had committed serious as well as heinous offence.
CJM after hearing both the sides and carefully going through the police report held that it appears from the police report that on January 15, 2008 at about 10.30 PM a marriage function was in progress at Chowadhi, accused along with other persons of locality were present there and with criminal intention lifted a minor girl of about 7 year old and took her to a separate room where he tried to forcibly commit rape upon her and also tried to strangulate her due to which the girl fell unconscious. The report about the occurrence was lodged to the police by the father of the girl on January 19, 2008 when he returned back from the place of posting. The medical examination of the girl reveals that she had sustained abrasion over right and left sight of the neck besides abrasion over right legs.
Court further said that the allegations against the accused are indeed very serious in nature as he has not only tried to commit rape upon the girl who is of very tender age but also tried to kill her by strangulation. It is no doubt true that bail cannot be refused as a matter of punishment but given the nature of accusation and the mental trauma caused to the girl and her parents, Court is of the considered view that the case is not fit for grant of bail to the accused and accordingly this bail application is rejected.
